NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
EACH ENTRANT AGREES TO THESE OFFICIAL RULES.
WINNER WILL BE REQUIRED TO PARTICIPATE IN THE PRIZE FULFILLMENT PROCESS AND MAY HAVE TO SIGN DOCUMENTATION, SUCH AS A RELEASE, IN SPONSOR’S SOLE DISCRETION AS MORE FULLY DESCRIBED BELOW, OR PRIZE MAY BE FORFEITED.
Official Rules: By participating in “The Body Shop Coca-Cola Scholars” Sweepstakes (the “Sweepstakes”), each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Buth-Na-Bodhaige, Inc., d/b/a The Body Shop®, 5036 One World Way, Wake Forest, NC 27587 (the “Sponsor”), which are final and binding in all matters related to the Sweepstakes. Winning any prize is contingent upon fulfilling all requirements set forth herein. Officers, directors, employees, independent contractors, representatives and agents of Sponsor and each of their respective parent companies, affiliates, subsidiaries, licensors, distributors, divisions, participating advertising and promotional agencies, and prize suppliers (collectively, the “Sweepstakes Entities”) and the members of their immediate families (parents, children, siblings, spouse) and/or those living in the same household (whether related or not) are not eligible to enter this Sweepstakes or win any prize.
Eligibility: You must be a legal citizen and current resident of the fifty (50) United States or the District of Columbia, and be eighteen (18) years of age or older to participate. Promotion is void in Puerto Rico, U.S. territories, possessions and commonwealths, and where restricted or prohibited by law. Entrants who have won a prize in any Sponsor promotion in the ninety (90) days prior to the commencement of this Promotion are ineligible. By entering, participants warrant and represent that they agree to be bound by these Official Rules and the final decision of the Sponsor.
How to Enter: The Sweepstakes begins on or about 4:00 a.m. Eastern Standard Time on April 18, 2013 and ends at 11:59 p.m. Eastern Standard Time on May 18, 2013(the “Sweepstakes Period”). To be entered into the Sweepstakes, participants must register a complete and valid email address online at www.thebodyshop-usa.com/scholars. Unless you opt out by registering, you grant permission to the Sponsor to send you special offers, new product releases and exclusive discount events for The Body Shop®. One entry per customer. Participants who have already registered at www.thebodyshop-usa.com cannot re-register at www.thebodyshop-usa.com/scholars but can be entered into the Sweepstakes by writing to The Body Shop® Coca-Cola Scholars Sweepstakes, The Body Shop Social Media Department, 5036 One World Way, Wake Forest, NC 27587 and quoting their registered email address.
Prize: The prize consists of one (1) One Hundred Dollar ($100.00) gift certificate (the “Prize”) to any The Body Shop® store in the United States.
Drawing and Notification: The Sponsor shall select one (1) prize winner from all eligible entries during a random drawing to be held on May 20, 2013. Sponsor decisions are final and binding in all respects. Odds of winning will depend on the number of eligible entries received. The potential prize winner will be notified by e-mail using the contact information given at the time of entry. The Sweepstakes Entities shall have no liability for any prize winner notification that is lost, intercepted or not received by the potential prize winner for any reason. If a potential prize winner cannot be reached or does not respond within five (5) calendar days from the first notification attempt, if the Prize notification is returned as unclaimed or undeliverable to such potential prize winner, then such person shall be disqualified and an alternate prize winner will be selected. If the potential prize winner is found to be ineligible, or if he/she has not complied with these Official Rules or declines a Prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. Sponsor will successively attempt to contact up to two (2) potential prize winners per Prize awarded in accordance with the above procedures, and if there is still no confirmed prize winner of the Prize after such attempts have been made, the applicable Prize may go unawarded. The decision of the Sponsor is final.
Prize Conditions: Prize winners are fully and solely responsible for any and all applicable federal, and local taxes. Except where prohibited by law, a prize winner’s entry and acceptance of the Prize constitutes permission for the Sweepstakes Entities and their designees to use said winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.
General Prize Conditions: The Sweepstakes Entities are not responsible or liable to any entrant or prize winner or any person claiming through such entrant or prize winner for failure to supply the Prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, volcanic eruption, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Sweepstakes Entities’ sole control.
Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to comply with and be bound by these Official Rules and the decisions of the Sponsor, which shall be final, and waive any right to claim ambiguity regarding the Sweepstakes or these Official Rules. Prize winner and entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and each of their respective officers, directors, employees, independent contractors, representatives and agents from and against any costs, claims, damages or liability of any kind due to any injuries, damages or losses to any person (including, without limitation, death and bodily injury) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, receipt, or use or misuse of the Prize offered or any part of the Prize, or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Any information collected by the Sponsor will be used by the Sponsor in accordance with the Sponsor’s privacy policy. If the Sweepstakes is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Sweepstakes.
Limitations of Liability: The Sweepstakes Entities are not responsible for entries not received due to errors, failures or any malfunctions, which may limit an entrant’s ability to participate. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the prize winner by randomly drawing from those entries received up to the cancellation/suspension date. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a Prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices.
Miscellaneous: Sponsor has the right to substitute any or all components of the Prize for another of equal or greater value due to Prize unavailability. IN NO EVENT WILL THE SWEEPSTAKES ENTITIES, OR THEIR RESPECTIVE AFFILIATES, SUBSIDIARIES, LICENSORS AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, INDEPENDENT CONTRACTORS, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE SWEEPSTAKES.
Winner List/Official Rules: For the list of winners or a copy of these Official Rules, send your request with a hand-printed, self-addressed, stamped envelope to: “The Body Shop Social Media Department re: The Body Shop® Coca-Cola Scholars Sweepstakes” 5036 One World Way, Wake Forest, NC 27587. Indicate whether you are requesting the identity of the winner or a copy of these Official Rules. Only one (1) request per outer envelope, mailed separately, will be fulfilled. All winners list requests must be received by May 31, 2013. Official Rules requests must be received during the Contest Period. These Official Rules are also available during the Sweepstakes Period online at thebodyshop-usa.com.
